About these terms
These terms govern your use of this website. They are not a funding agreement. If we make you an offer, that offer and the agreement you sign will contain its own terms, and those will govern the funding itself.
The nature of what we provide
Consistent Funding Group arranges business-purpose financing for businesses operating in the United States. Nothing on this site is an offer of finance, a commitment to fund, or advice — financial, legal, tax or otherwise. Every application is assessed on its own facts and we decline applications routinely.
Merchant cash advances are not loans
A merchant cash advance is the purchase of a specified amount of your future receivables at a discount. It is not a loan. Its cost is expressed as a factor rate, not an annual percentage rate, and the two are not directly comparable. Remittance is a fixed percentage of your daily card settlements, so the amount collected moves with your sales.
Before you sign anything you will see the purchase price, the amount purchased, the remittance percentage and the total cost. If any of that is unclear, ask us and we will explain it before you commit — not after.

Liability
The site is provided as it is. To the fullest extent the law allows, we exclude liability for indirect or consequential loss arising from your use of it. Nothing here limits liability that cannot lawfully be limited — including for fraud.
Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. The courts of New York County have exclusive jurisdiction over any dispute arising from them.
